Suprema Corte de Justicia de la Nación validó las enmiendas realizadas por el Congreso del Estado
TIJUANA.- El Diputado René Mendívil Acosta destacó la validación que el Pleno de la Suprema Corte de Justicia de la Nación hizo a la reforma política que el Congreso del Estado aprobó en los meses de mayo y junio del presente año.
El Coordinador Parlamentario del PRI recordó que las enmiendas aprobadas a la Constitución del Estado de Baja California y a la ley Electoral del Estado están la figura de la paridad entre géneros en candidaturas a diputados y en planillas a munícipes tanto propietarios como suplentes, así como la figura de revocación de mandato.
Otra de las enmiendas, agregó, son las relacionadas a la fórmula para asignación de diputados por el principio de representación proporcional, la edad de 18 años para ser electo a un cargo de elección popular y la fecha de inicio del proceso electoral que será el segundo domingo de septiembre y la jornada el primer domingo de junio.
Además, dijo, la reforma faculta al Congreso el aprobar el Plan Estatal de Desarrollo que remita el Gobernador, la posibilidad de iniciar leyes de los ciudadanos, organizaciones de la sociedad civil en los asuntos para los que fueron constituidas y a las instituciones de educación superior en términos de la ley, entre otros asuntos.
Por otra parte, comentó Mendívil que la invalidación de la SCJN, se refiere al segundo párrafo del artículo 14 de la Constitución, de los artículos 41 y 59 de la ley de Partidos Políticos del Estado y del artículo 172 de la Ley Electoral, donde los ministros expulsaron el criterio geográfico de la norma y determinaron que sólo debe prevalecer el criterio poblacional en el cual seguían rigiendo 17 distritos y el mismo censo poblacional, determinando que la distritación electoral previa a la reforma de doce de junio de dos mil quince sería la que prevalecería.
Si bien, puntualizó el legislador, la Suprema Corte pretendió dar certeza a la elección, lo cierto es que se generó confusión en los efectos de la sentencia pues a partir de la reforma federal en materia político electoral de diez de febrero de dos mil catorce.
Pues, dijo, el Instituto Nacional Electoral inició los trabajos tendientes a formular los proyectos para la nueva demarcación territorial de la geografía electoral nacional, y en términos de la nueva legislación y desde ese año, se llevaron a cabo los trabajos técnicos por parte de quien tiene la facultad constitucional y aplicando el criterio poblacional y el último censo general de población, dividió la población total de la entidad entre los diecisiete distritos, de ahí que el veinticuatro de junio, aprobó la nueva demarcación distrital sin que para ello haya tomado en cuenta la reforma electoral del Estado, por lo que los trabajos y acuerdos del Consejo General deben de subsistir.
