• Los indiciados cuentan con antecedentes penales.

 detenidosTIJUANA, B.C., A 11 DE ABRIL DE 2015.-  La Subprocuraduría Contra Delincuencia Organizada a través de la Unidad Orgánica de Homicidios Dolosos, consignó ante el Juez Penal a cuatro sujetos presuntamente responsables del delito de homicidio calificado en grado de tentativa  y en grado de coautoría, cometido el 8 de abril del 2015, sobre la Avenida de Las Ferias de la colonia Hipódromo II.

Los indicados responden a los nombres de Carl Ray Jr Flores de 38 años de edad, alias ‘’El Carpintero’’, originario Nevada, Estados Unidos;  Daniel Pérez Eugenio de 29 años de edad, originario del Distrito Federal; Juan Carlos Sinfuentes González de 41 años, originario de Nayarit y Francisco Villegas Borbón de 27 años de edad, originario de Sonora.

El día antes mencionado, Aaron Leib Kobisher Padilla, Antonio Reyes Azcanio y Oscar Daniel Montes Valencia, éste último es Policía Comercial, de manera violenta fueron agredidos con diversas armas de fuego de alto poder por parte de los hoy indiciados, con la finalidad de privarlos de la vida, hechos que no se consumaron debido a la intervención de Oscar Daniel Montes, agente de la Policía Municipal sección Comercial, asignado como escolta particular de las víctimas y quien repelió la agresión con su arma de fuego a fin de salvaguardar la integridad física tanto de las personas que escoltaba como la propia.

Los ofendidos circulaban de manera pacífica en el vehículo de motor marca Chevrolet, tipo pick up, doble cabina color blanco, modelo 2011, siendo conducido por el chofer de nombre Antonio Reyes Azcanio y en el asiento trasero iba el de nombre Aarón Kobisher Padilla así como su escolta.

 

Al desplazarse por la avenida de Las Ferias, el escolta se percató que un vehículo de la marca Dodge Durango color guinda,  venía a gran velocidad tratando de rebasarlos  por el lado izquierdo, pero como había vehículos no lo lograron.

 

Al ver la irregularidad, el escolta  se posicionó con su arma de fuego para cualquier eventualidad y fue en esos momentos en que el conductor de la Dodge Durango, de manera intencional los envistiera del lado izquierdo a la vez que les empiezan a disparar en repetidas ocasiones generando con esto,  que dicho escolta,  repeliera la agresión en cuatro tiempos distintos, perdiendo el control del vehículo ambos chóferes para finalmente impactarse cada quien en diferentes puntos.

 

Fue en esos momentos,  en que tres de los sujetos que iban en el vehículo agresor descendieron del mismo armados con fusiles de alto poder calibre .223  con la intención de ejecutar a los hoy ofendidos, pero como ya el escolta había pedido apoyo vía radio,  llegaron diversas unidades de la policía municipal, los cuales aseguraron a los responsables de los hechos.

 

Estos hechos fueron corroborados con las declaraciones tanto de testigos como de los propios indiciados, las cuales fueron practicadas por esta fiscalía y dentro de las mismas declaraciones, dichos indiciados aceptan haber participado en tales sucesos.

 

Al momento de la detención de los presuntos responsables se les encontraron diversas armas de fuego por lo que se pusieron a disposición de la Federación para su determinación, mismos que en su momento también el Agente del Ministerio Público Federal ejercitó acción penal en contra de los indiciados.

 

Por lo que existen elementos suficientes para que esta fiscalía también ejercite acción penal en su contra, ya que se tiene por acreditada la participación directa de los inculpados en el delito de homicidio Calificado en grado de tentativa.

 

Es importante mencionar que los hoy detenidos cuentan con antecedentes penales: el de nombre  JUAN CARLOS SIFUENTES GONZALEZ  fue deportado hace dos años de los Estados Unidos, después de cumplir una condena de 20 años en el Estado de California por el delito de homicidio.

CARLOS REY FLORES  fue deportado de los Estados Unidos, después de cumplir una condena de 24 años en el Estado de California por el delito de homicidio y el de nombre FRANCISCO VILLEGAS BORBON se encuentra firmando por los delitos de agresión física, así como DANIEL PEREZ EUGENIO cuenta con orden de aprehensión en esta ciudad, por el delito de robo calificado

Por lo anteriormente expuesto, el 9 de abril del 2015, se ejercitó acción penal en contra de los referidos indiciados poniéndolos a disposición del Juez de Primera Instancia de lo penal en Turno quien determinará su situación legal.
